QUICK CHECK LIST
RECEIVING PROCEDURES
Only trained personnel should receive the freight.
Always compare ALL documents before signing the freight bill.
Be sure the freight bill is Signed and Dated by the delivery driver.
Sign for goods in the location where physically delivered.
Make sure every package shows "your company name" as the consignee.
Verify the piece count: Sign only for Units as shown on the bill and received as such. Always sign for freight exactly as received (assume nothing).
Verify the method of tender, how goods were billed/shipped against the manner of receipt (how the goods were actually received) - Note on the freight bill any variation in the packaging or count.
Directional Markings: Note on the freight bill the improper position of any package. .
Note Tilt watch or Shock watch devices when "RED."
Method used to seal containers: Are they all identical? Are some banded and others taped? Different kinds of tape - assorted colors? Boxes all taped but staple holes are present?
Containers: Are they shipper originals, reused, damaged? Pallets: Are they unusual, broken, and flimsy - not the type ordinarily received. Are some shrink-wrapped and others banded?
Inspect the freight: Check for open boxes. Damaged containers (punctured, torn, buckled, crushed). Ruptured tape (edges of box). Open and inspect any package showing probability of damage. Record any Packaging/Container damage on the freight bill. i.e.: Record any Missing/Altered packaging materials (tape, banding etc.). Avoid vague or general statements. Example: "1 Box short" (incorrect). Always identify the products short or damaged, if possible. Indicate the quantity and type of merchandise damaged. Show model and serial number, or similar product identification.
"The freight bill is only `prima facie' evidence that the shipping container or its contents were received in "good order". Where there are no exceptions on the freight bill to indicate loss or damage at time of delivery, the burden of providing such "clear and convincing evidence" rests with the claimant. Often such evidence is determined following a detailed inspection, usually performed by an outside agency at the request of the carrier or another interested party.
THE Damaged Freight Inspection REPORT
The consignee is obligated to request an inspection by the carrier where loss or damage was not determined at time of delivery according to the provisions of Rule 300135 and 300140, respectively. Where visible damage is the case, and annotated on the delivery receipt, either the consignee or carrier may initiate the inspection process. However, the carrier is not compelled by statute or regulation to inspect damaged goods as part of their investigation. This is because the amount of the claim in many situations or in a particular set of circumstances may not warrant the cost of an inspection.
Inspection waived:
Should the carrier elect to waive his right to an inspection, or request that you complete an inspection form, do not hesitate to do so. But it is highly recommended that you obtain the name and position of the representative making such a request, and if at all possible, for your protection, solicit confirmation in writing.
Consignee inspection
Regulations stipulate that when an inspection is to be conducted it must be made within five (5) normal working days, excluding Saturdays, Sundays and holidays. After such time the consignee may conduct its own inspection to the best of his ability.
Under these conditions:
The consignee inspection, in such cases, will serve as carrier's inspection and will not unduly hinder the payment of his claim based upon the facts contained therein. (Refer to Item 300145 of NMFC 100).
Joint inspection
When an inspection is made; remember that it is a "joint" inspection by you and the carrier's representative. You both sign the report, thus read it thoroughly to insure its accuracy and completeness. Beyond the correct rendering of the facts, make sure that the inspector does not express opinions that would relieve the carrier or shipper of liability. Examples: "fork lift damage," a prejudicial judgment without firsthand knowledge; or "inadequate packaging," a biased and argumentative opinion expressed without a proper knowledge of tariff packaging requirements. REMEMBER: The completion of an inspection report is not in compliance with nor does it constitute the filing of a claim in writing.
BILL OF LADING The bill of lading generally does not travel with the freight. Instead, carrier's cut a freight bill containing information that is identical with that found on the bill of lading or contract of carriage. The original contract is usually retained by the shipper. A pro sticker is assigned to the bill of lading, designating the freight bill number a particular shipment is scheduled to move on. In the event of a claim, both the bill of lading and freight bill should be provided. These two documents bear identical facts relative to the Pro (freight bill) number, consignee or owner of the goods, destination, piece count, commodity description, and all other information of propriety to identify the shipment. Moreover, they serve to establish the common carrier(s) who participated in the handling and transportation of said property. A copy of the bill of lading can be obtained from the shipper.
Shipper retains original: As a common practice the shipper will not surrender the original bill of lading. In any case, most carriers will accept a photo copy of this document as it can be compared against the copy retained in their files at the origin terminal.
SALVAGE RIGHTS if a carrier pays your claim for the full invoice price of damaged goods, unless otherwise agreed to, it is entitled to the property as salvage. However, the consignee is cautioned not to release the damaged goods for salvage until the carrier has acknowledged liability for the full value.
Salvage pick up (See p.32: Damaged freight salvaged by consignee) Rule 300150 provides that where carrier liability has been established it will take possession of the salvage as soon as possible, but not more than 30 days from the date shipment was noted damaged on carrier delivery receipt or, if concealed damage, from date of the inspection report. If the carrier fails to pick up the salvage within this period of time, consignee must contact the carrier and request removal of the salvage
within fifteen days from the date of notification. NOTE: Only applicable when it is agreed to by both carrier and consignee that the carrier will handle disposition of the salvage.
